Drug Crime Penalties
Drug penalties in Tennessee vary widely depending on the drug’s schedule classification, the quantity in possession, and the specific nature of the offense.
Penalties can include jail or prison sentences, fines, probation, community service hours, driver’s license suspension, and asset forfeiture.
For example, simple possession or casual exchange of a Schedule I drug is generally a Class C felony punishable by three to 15 years in prison and a fine of up to $100,000.
On the other hand, possession of less than half an ounce of marijuana, a Schedule VI drug, is a misdemeanor carrying a penalty of up to one year in jail and a maximum fine of $250. Fines increase with repeat offenses.
The penalties for drug sales, distribution, and trafficking are even more severe, with the possibility of decades-long prison sentences and fines up to $500,000. Manufacturing drugs or conspiracy to commit drug crimes also attract heavy penalties.
